The application or form process / member login area

 

We provide background checks, identity validation and due diligence - submitted to us by a customer or requestor, usually an employer. The requestor asks for identity validation or background information, screening, references on another party or subject.

 

To enable identity validation, due diligence and background checks, we use third party data sources and platforms. Searches are conducted with the Subject’s consent and awareness, when the Subject is required to input Personal Data into or use a third party provider’s platform this is clearly stated and indicated and the Subject acknowledges being under the third party provider’s Terms & Conditions and Data / Privacy Policies. Your data is not sold on or transferred for any marketing or advertising purposes. 

 

Please read these Terms & Conditions in conjunction with the Privacy Policy. Personal Data is as defined by the UK Data Protection Act (1998) and may be included in the information that we collect from you. All personal data supplied to us by users is treated confidentially and stored in accordance with good industry security practice for as long as it is stored by us. 

 

By providing us with Personal Data you warrant that you have all the necessary rights and consents to do so. You acknowledge that solely you are responsible for the information that you provide and make available for the purpose of Context Checks providing a service, and that the information is provided legally. You agree that Context Checks may access, store and use any information that you provide in accordance with the terms of the Privacy Policy. 

 

By entering your Personal Data or required details into the form in our member area or via our website and by ticking the content box, you acknowledge and consent to Context Checks using the details provided by you to conduct background checks and identity validation. The information we will process about you might include the following: 

Name, date of birth, telephone number, email address, address, age, gender, nationality, social sign in profile information, digital images of face and government issued identity document, proof of address document, CV, basic financial check, location data, online presence, directorships, employment history / references, proof of qualification.

You consent to us submitting your Personal Data via identity validation or official compliance databases. You consent to the background checks, identity validation or due diligence results to be shared with the requestor. 

 

You acknowledge that once the process has been conducted and finalised, whilst Context Checks will not retain your Personal Data, we will keep a basic record of your information solely for audit purposes (i.e. full name and date check conducted). We may retain anonymised data for improvement of our products and services or to inform trends and analysis. 

You may email us or Contact us at any time during the process to cancel and request to have your data removed. If you have any special requests or limitations to the data you would like to provide please contact us in writing at the email above, please note this may result in an inability for us to complete a background check or identity validation. You may request to access your data at any time during the process with us but we do not retain complete reports or your Personal Data 72 hours after the report has been submitted to the requestor, please consult directly with them for their Terms & Conditions, Privacy Policy or contract(s) with you.  

Our responsibility for loss or damage suffered by you

Whether you are a consumer or a business user:

  • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

  • Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products to you, which will be set out in our Terms and Conditions of supply / Service Agreement with you.

If you are a business user:

We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

Which country's laws apply to any disputes?

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
